1. Agreement to Terms
By accessing or using the Dedicated Live Dispatch service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including customers, agents, and administrators.
2. Service Description
Dedicated Live Dispatch provides live, human-powered answering and dispatch services for trades businesses. Our agents answer your inbound calls, collect caller information, and dispatch jobs to your preferred CRM or via manual notification. We do not use AI or automated systems to handle calls.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Free Trial
New customers may be eligible for a 7-day free trial. During the trial, you will have access to the full Service. At the end of the trial period, your subscription will begin automatically unless you cancel before the trial ends. No credit card is required to start the trial.
5. Pricing, Billing, and Payment
Our Service is offered on a flat-rate monthly subscription basis. Each plan includes a set number of minutes per month. Usage beyond the included minutes will be billed at the overage rate specified in your plan.
- Subscription fees are billed monthly in advance.
- Overage charges are billed at the end of each billing period.
- All payments are processed securely through Stripe.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are issued at our sole discretion and are not guaranteed.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to any part of the Service or its systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit harmful, threatening, or abusive content.
- Resell or redistribute the Service without our written consent.
- Provide false or misleading information to our agents or use the Service to defraud third parties.
7. Call Recordings
Calls handled through our Service may be recorded for quality assurance and training purposes. You are responsible for ensuring that your callers are informed about call recording in accordance with applicable laws. Recordings are retained for 90 days and can be accessed through your dashboard.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Service Availability
We strive to maintain 24/7 service availability but do not guarantee uninterrupted service. We are not liable for any downtime, delays, or service interruptions caused by factors beyond our reasonable control, including telecommunications outages, natural disasters, or third-party service failures.
10. Limitation of Liability
To the maximum extent permitted by law, Dedicated Live Dispatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Dedicated Live Dispatch, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. You may cancel your account at any time through your dashboard or by contacting support. Upon termination, your right to use the Service ceases immediately. Data deletion requests will be honored in accordance with our Privacy Policy.
13. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where our principal office is located. Each party shall bear its own costs.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
